Infringement Policy
Version 2026-08-20
ListMyIndia hosts listings, photographs and reviews submitted by users and imported from public sources. We do not author that content, but we do act on valid complaints about it. This page explains how to tell us that content on ListMyIndia infringes your rights, what a notice must contain for us to act on it, and what happens next.
Where to send a notice
Send infringement notices to the Grievance Officer, Mr. Sanjeev Kumar, at [email protected] with "Infringement Notice" in the subject line. Notices sent to general support or through social media may not reach the officer and may not be acted upon.
1. What this policy covers
This policy covers content on ListMyIndia that you believe infringes rights you own or are authorised to enforce.
- Trademark — your brand name, logo or mark used in a listing without authorisation, including a listing that impersonates your business.
- Copyright — your photographs, written descriptions or other original material published without permission.
- Impersonation and false attribution — a listing that presents itself as your business, or attributes to you goods, services or statements that are not yours.
- Personal rights — your name, photograph or personal information published without consent.
Complaints about the quality of a business, a transaction that went wrong, or a review you disagree with are not infringement matters. Use the reporting option on the listing instead.
2. What a valid notice must contain
So that we can identify the content and act quickly, a notice must include all of the following. An incomplete notice will be returned to you rather than acted upon, which costs time for both of us.
- Your name, postal address, telephone number and email address.
- The capacity in which you act — the rights owner, or an authorised agent, with evidence of that authority.
- Identification of the right you rely on: for a trademark, the registration number and jurisdiction; for copyright, a description of the work and how you own it.
- The exact URL of every listing, photograph or review complained of. A business name alone is not enough to identify content on a directory of this size.
- An explanation of why the content infringes the right identified.
- A statement that you believe in good faith that the use complained of is not authorised by you, your agent or the law.
- A statement that the information in the notice is accurate, and that you understand a false or misleading notice may expose you to liability.
- Your physical or electronic signature.
3. How we respond
We acknowledge receipt within 24 hours and aim to resolve complaints within 15 days of receipt, in line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
- We review the notice for completeness and, where it is complete, assess the content complained of.
- Where we consider the complaint well founded, we remove or disable access to the content and notify the person who posted it, giving them the substance of the complaint.
- Where the position is unclear, we may ask either party for more information before acting.
- Where we are served with a court or government order, we act on it as required by law.
We are not in a position to adjudicate contested questions of ownership between two businesses. Where a dispute genuinely turns on who owns a mark or a work, our role is limited to acting on a valid notice and, where appropriate, on a competent authority's order.
4. If your content was removed
If your listing or material was removed and you believe that was wrong, you may send a counter-notice to the same address. It must contain your contact details, identification of the material removed and where it appeared, and an explanation of why you are entitled to publish it — for example a licence, a prior registration or your own ownership of the mark.
We will pass a counter-notice to the original complainant. Where the complainant does not respond within a reasonable period and we have no other reason to keep the content down, we may restore it.
5. Repeat infringers
Accounts that are the subject of repeated valid notices will have their listings removed and their access to ListMyIndia terminated. We keep a record of notices received and of the action taken on each.
6. Misuse of this process
An infringement notice is a serious statement. Notices sent to remove a competitor's legitimate listing, to suppress an unfavourable but genuine review, or on rights the sender does not hold, are a misuse of this process.
We may decline to act on notices from a sender with a history of unfounded complaints, and a person who submits a materially false notice may be liable to the person whose content was removed.
